Bonds
and bail have to do entirely with the 8th Amendment of the United States
Constitution. According the the 8th Amendment, a non-excessive
bond must be set in every non-capital case. Excessive is
interpreted to mean that a bond should not be set at an obscene amount
that could be misconstrued as having to do with raising money for the
government.
Bond's are used to assure the courts that the defendant will not flee from the area to avoid future court proceedings. Occasionally, as in the case of a Violation of Probation (VOP), some judges do not set a bond at all.
